Railroad Protective

What is railroad protective coverage?
Railroad protective is liability protection for railroads from acts of contractors working within 50 feet of the railroad tracks or private land owners that have railroad tracks running across their land where the public crosses over the tracks. 

Why do I need railroad protective coverage?
Railroads usually have a right-of-way around tracks and control who does work within their right-of-way.  Because of significant legal liabilities imposed on railroads for incidents that occur on their premises or right-of-ways, contractors or landowners are required by the railroad to purchase a railroad protective policy to protect the railroad from claims from these exposures.  The policy is paid for by the contractor or land owner, but the named insured is the railroad.  The railroad protective policy is project specific and therefore, is needed for each project being performed.

Why do I need railroad protective coverage?
By requiring a separate railroad protective policy, the railroad does not need to worry whether a contractor or land owner’s general liability policy provides coverage or that their insurance limits may be exhausted by other claims.
