Insuring Agreements

E-Pack (EPLI, D&O and Fiduciary):

Professional Liability for Design Firms, Environmental Consultants and Specialty Construction Consultants:

  • The 2005 Insuring Agreement is subject to state filing procedures. Contact your broker for information on the insuring agreement pertaining to your firm.
    • Provided here is a list of changes from the previous agreement.
    • Our new insuring agreement is available in DC, PR, VI and all states except CA, CT, NY & VT
    • Risk Mitigation Credit offered to policyholders. This new insuring agreement includes a Risk Mitigation Credit to eligible policyholders which provides the option of receiving a deductible credit of up to $25,000 if they implement certain best practices in the engagement and performance of professional services. This booklet provides information on the credit and eligibility requirements.

  • The 2006 NY Free Trade Zone Insuring Agreement is in use beginning with policies effective on or after September 1, 2006 for all professionals eligible for coverage under the Free Trade Zone regulation. Eligible professionals include: Architects, Engineers, Land Surveyors and Landscape Architects. Non-licensed design professionals in NY, such as Envirnomental Consultants and Specialty Construction Consultants will continue to be written using our 1999 NY Insuring Agreement until further notice.


  • The 1999 Insuring Agreement was used in DC, PR, VI and all states except NY and SD. If the 2005 insuring agreement is not yet available in a state, the 1999 insuring agreement will continue to be used (except in NY and SD).


  • The SD Insuring Agreement continues to be used in SD until further notice.
