Challenges and Opportunites: The Realities of the New A201

The influences of present day construction industry practices and risk management concerns are reflected in the new AIA General Conditions of the Contract for Construction (A201). The document also makes minor language changes that have an impact on the relationships between contractor and owners and on design professionals as the agents of the owners. Some of the attributes of A201 include:

  • Positive changes to the rights and duties of the contractor.
  • A reduction in risk shifting between contractor and owner through a mutual waiver of claims for consequential damages.
  • Protection for the contractor through indemnification by the owner for damages from existing or required hazardous materials.
  • A narrowing of the contractor’s indemnification obligation and the inclusion of Project Management Protective Liability Policy as an alternative to indemnification.
  • Authority to perform or contract for design services at the request of the owner and architect without direct esponsibility for the adequacy of the performance or design criteria.
